By using Sabado Real Estate Media Services, you acknowledge that we strive to provide high-quality media content but do not guarantee specific results. You assume all responsibility for the use of the media and any legal issues that may arise. Sabado is not liable for inaccuracies in the information you provide or for indirect or consequential damages. We may use third-party services, subject to their own terms, and do not endorse or guarantee the value or condition of any property featured. You agree to indemnify Sabado for any claims related to your use of the media and must comply with all applicable laws. Ownership of media is transferred upon full payment, with Sabado reserving the right to use the content for promotional purposes unless otherwise agreed.

Terms & Conditions - The Basics

1. Overview

By booking Sabado’s services, you agree to these terms and conditions. These terms govern the use of the services provided by Sabado for real estate media, including photography, videography, and drone services.

2. Service Delivery

Sabado will provide the agreed-upon services as described in the booking confirmation. Delivery timelines are estimated, and while Sabado strives to meet deadlines, delays may occur due to unforeseen circumstances.

3. Changes to Completed Services

Once services are completed and delivered, any changes or edits requested by the client will incur an additional fee based on the nature of the changes. Major alterations or reshoots will be subject to a new service agreement and pricing.

Re-editing: Minor tweaks (color correction, cropping) are available within 30 days of delivery at no extra charge.
Major Revisions: Significant changes, including re-shooting or adding new content, will require a new contract and fees.

4. Refunds and Cancellations

Refund Policy: Refunds are not available once the work has been completed and delivered. In cases of non-delivery due to failure on our part, a refund will be considered.
Cancellations: If a service is canceled 48 hours before the scheduled appointment, the client will incur a 50% cancellation fee. Cancellations within 24 hours will result in a 100% charge of the agreed service fee.

5. Privacy and Confidentiality

Sabado respects the privacy of its clients and their property. We will not share or distribute any media created for the client without explicit consent, unless required for legal purposes.

Client Data: Any personal information shared with us for the purpose of booking services will be kept confidential and used solely for the purposes of service delivery and customer relationship management.
Media Usage: Unless otherwise agreed upon, Sabado reserves the right to use the media content produced for marketing, portfolio, and promotional purposes, including on our website and social media platforms.

6. Ownership and Rights

All media produced remains the intellectual property of Sabado until full payment for services has been received. Upon full payment, ownership of the media (excluding any underlying intellectual property rights such as music or stock images) will be transferred to the client.
The client may use the media for promotional, marketing, and real estate purposes.

7. Liability and Insurance

Sabado holds general liability insurance to cover any damages or loss incurred during the execution of services. However, we are not responsible for damages caused to property, accidents, or injuries that may occur during the shoot.

8. Disputes and Governing Law

In case of disputes, both parties will first attempt to resolve the matter amicably. If a resolution cannot be reached, the dispute will be governed by the laws of Ontario, and any legal proceedings will take place in the appropriate jurisdiction.

9. Payment Terms

Payment for services is due upon receipt of the invoice, with a 50% deposit required at the time of booking. Payment methods include [list accepted payment methods]. Late payments will incur a 2% late fee per month on the outstanding balance.

10. Force Majeure

Sabado will not be held liable for any failure or delay in service delivery due to circumstances beyond our control, including but not limited to natural disasters, pandemics, or other unforeseen events.

11. Modifications to Terms

Sabado reserves the right to amend these terms and conditions at any time. Any changes will be communicated to clients, and the revised terms will apply to all future bookings.

Legal Law Compliance

By using Sabado, you agree to comply with all applicable laws and regulations in Ontario, Canada. Our services and terms are governed by Ontario law, and any disputes will be handled in Ontario courts. You are responsible for ensuring that your use of our media content complies with all relevant legal requirements, including those related to advertising, privacy, and intellectual property, as outlined under Ontario’s Consumer Protection Act and other applicable legislation.
